1. Objectives and General Considerations
These General Terms and Conditions are intended to regulate the terms under which the website www.livingpdl.pt, owned by Maria da Luz Vieira Cabral de Melo Amaral, with tax identification number 103414436, referred to as Living PDL, will operate. They will apply from the moment a reservation is requested until the accommodation period at Living PDL ends.
The presented Terms and Conditions apply to the relationship between the guest visitor, hereinafter referred to as the “Client,” and Living PDL, to the website functionalities and rules, and to the regulations regarding the stay, including operating hours and services provided, as well as other relevant information.
By using the Living PDL website, you fully accept and agree to all the parameters presented in these Terms and Conditions, as well as the Privacy Policy and Cookies Policy in effect, as presented on the website. If you do not accept, in full or in part, any of the stipulated conditions, you should not take any action on the website.
Living PDL reserves the right to update, change, remove, or exchange any content in the Terms and Conditions, as well as the website, without prior notice. It is advisable to periodically review the Terms and Conditions to check for any changes or updates.
For situations not covered by these Terms and Conditions, the applicable legislation will be followed.
2. Prices
All prices on the website are presented per apartment for the entire stay, including VAT and all taxes, unless otherwise stated on the website or in the confirmation email. Occasionally, more economical rates may be available on our website, depending on different variables such as the selected regime or the period of stay. Please carefully check the room description and rate before making your reservation.
• The price of the stay to be paid by the Client constitutes the consideration for the use of the accommodation, for the period between arrival and departure.
• Published prices may be subject to change without prior notice.
• No charge is made for children under 2 years old, as long as they are accompanied by the responsible adults. Living PDL should always be informed of the inclusion of children in the reservation so that accommodation adjustments can be made if necessary.
• Living PDL reserves the right to terminate the accommodation contract if the Client fails to pay the price in full and on time when it is due.
3. Payment Conditions
The payment for accommodation during the stay and other services must be made at the time of reservation confirmation.
This amount, as well as the cancellation fee, will be mentioned at the time of booking and may vary depending on the promotional rate or the type of accommodation chosen by the Client.
Living PDL accepts the following payment methods:
• Credit Card: With this payment method, Living PDL will request your card details to secure your reservation. All payments will be processed securely, and the provided data will be handled confidentially and non-transferrable. Charges made to credit cards will be processed exclusively by Living PDL. Living PDL commits to responding to any request from the cardholder within a maximum of two days. Living PDL recommends keeping a copy containing transaction details for future reference if necessary. The transaction will be made by Maria da Luz Vieira Cabral de Melo Amaral after reservation confirmation. Living PDL guarantees the refund of the reservation amount if a valid consumer withdrawal is exercised, if applicable, as defined by Consumer Protection laws.
• Multibanco: When selecting this payment method during booking, a Multibanco reference will be automatically generated, which will be provided to the Client in the reservation confirmation email. This method requires payment within 24 hours of booking; otherwise, Living PDL may cancel the reservation. This payment method is valid only in Portugal.
• Bank Transfer: If this payment option is selected, the confirmation email will provide the NIB of the account where the amount should be transferred. The Client must confirm the payment by sending proof to the email living.pdelgada@gmail.com. This method requires payment within 24 hours of booking; otherwise, Living PDL may cancel the reservation.
4. Cancellation Policy
The cancellation policy applies to all bookings made on the website, including those with mandatory deposits.
• If the Client does not check in at the accommodation unit on the first day of the booking without notifying, Living PDL reserves the right to cancel the reservation and may apply a penalty of up to 100% of the booking amount.
• Modifications to the reservation may incur additional fees.
• In case of cancellation or no-show at the accommodation unit, the full booking amount will be charged.
• Delivery Rules and Deadlines: Living PDL commits to providing the contracted service once the booking process is completed, within a maximum of 24 hours. Living PDL gives the Client the possibility to cancel the reservation under the legal right of free withdrawal, as long as it is within the legal period (14 calendar days), without any justification or cost. Living PDL commits to refunding the charged amount when a cancellation is validated according to the previous point.
• Living PDL reserves the right to terminate the accommodation contract if the Client does not pay the price in full and on time when it is due.
• Any contracting party may terminate the accommodation contract summarily for just cause according to the previous clauses.
• Living PDL may also immediately terminate the accommodation contract for just cause if the Client exhibits behavior that affects the good coexistence, peace, or hygiene of the accommodation, such as being under the influence of drugs or alcohol, using the accommodation for prostitution, acting offensively toward the accommodation staff, disturbing the peace of other guests, or having made false malicious reservations in the past or damaged the accommodation or its facilities.
• Without prejudice to the general conditions and cancellation policy already described, there may be specific conditions indicated in the reservation.
5. Check-In and Check-Out
• Living PDL provides accommodation starting at 16:00 on the arrival date.
• Before arrival (check-in), the Client must return the check-in form sent, filled in with identification data, nationality, and address, as well as provide identification documents, such as ID card or passport, if requested.
• The Client must, whenever possible, indicate the time of arrival.
• If the Client wishes to check in earlier, they should contact Living PDL to check availability for the indicated date. If not possible, the Client may leave luggage in a designated area.
• The Client must vacate the accommodation by 11:00 on the departure date, leaving no persons or belongings behind and without any damages.
• If the Client wishes a “late check-out,” they should contact Living PDL as early as possible to check availability. The “late check-out” is subject to availability and will incur an additional charge of 30% of the daily rate for the respective reservation.
• If the accommodation is not vacated by the time specified in these Terms and Conditions, and without prior notice or consent from Living PDL, a compensation equivalent to one night’s stay will be charged, and the Client will only be allowed to use the accommodation during this period if availability permits.
6. Cleaning, Towels, and Bed Linen
• Upon check-in, the apartment will be fully cleaned and sanitized, and bath towels (bathroom) and beach towels will be provided for all guests.
• Towels for the bathroom are not permitted to be used outside the Living PDL premises.
• Beach towels provided by Living PDL can be used on beaches, bathing areas, or thermal areas for that purpose.
• Clean and sanitized bed linen and pillows will be provided. The beds will be made and ready for use upon check-in.
• The Client may request a change of bed linen and towels if necessary.
• If an unforeseen cleaning intervention is needed, it should be scheduled with the cleaning staff. Living PDL commits to performing the cleaning as soon as possible.
7. Access to the Apartment by Living PDL
• Living PDL and its staff will never enter the apartment without the Client’s consent, prior notice, and scheduling.
• If additional maintenance or cleaning is required, it should be requested and scheduled between the Client and Living PDL.
8. Complaints Regarding Material Defects
• The Client must inspect the apartment upon arrival and immediately report any defects found to Living PDL.
• Any defects that arise during the stay must be communicated to Living PDL as soon as the Client becomes aware of them.
• Living PDL will seek to correct any identified defects or damages as soon as possible.
• If Living PDL is unable to repair the relevant defect or provide the Client with equivalent accommodation, the Client may terminate the contract and receive a refund for the amount paid for the apartment, without further claims against Living PDL.
• For non-serious defects that do not affect the service or quality level, Living PDL is not obligated to take any action in response to unreasonable or irrelevant complaints regarding details that do not violate the minimum contracted service level.
9. Responsibility of Living PDL
• Living PDL is responsible for ensuring the appropriate hygiene, cleanliness, and safety conditions of the accommodation.
• Living PDL is not responsible for personal belongings that may go missing within the apartment.
• Living PDL does not assume responsibility for damages or personal accidents occurring anywhere in the apartment unless such accidents are caused by Living PDL’s negligent actions.
10. Rights and Duties of the Client
Client Rights
• Confidentiality by Living PDL regarding the use of personal data.
• Apartment arrangement and cleaning.
• Free Wi-Fi.
Client Duties
• Respect the rules established for compliance with these Terms and Conditions.
• Honor the personal dignity of staff, owners, and others.
• In the case of theft, property damage, fire, flooding, anomalies, or deficiencies in the accommodation or services provided, the Client must immediately report them to Living PDL for swift resolution.
• Use the Living PDL apartment and spaces properly, always assuming responsibility for any damage caused to the accommodation.
• Not take property from the accommodation unit as their own.
11. Rules
• The Client must not use devices that may jeopardize the safety of people and the Living PDL premises.
• Smoking is prohibited inside Living PDL.
• Weapons or sharp objects that may endanger life are not allowed.
• Out of respect for other accommodations, noise and disruptive activities are prohibited between 11 PM and 7 AM.
• Parties are not allowed.
• External guests are not allowed unless pre-approved by management.
• Children under 12 must be supervised by an adult Client at all times during their stay.
• Pets are prohibited.
12. Damages and Losses to Property
The Client is obliged to compensate Living PDL for any damage caused to the accommodation and/or its supporting facilities, as well as for damages resulting from violations of the duties established in these Terms and Conditions, including attorney’s fees and court costs.

Living PDL provides a complaints book.
15. Additional Information
It is the Client’s responsibility to inform Living PDL of the number of people (adults and children) occupying the accommodation.
If more people show up than those indicated in the reservation, the Client’s entry may be refused without reimbursement.
17. Legal Provisions
• No verbal agreement has been reached during the accommodation contract; any amendments to the agreement must be in writing and signed by both parties, unless it is a unilateral declaration, in which case it must be in writing and signed by the issuer.
• Living PDL has the right to have third parties fulfill its obligations under the accommodation contract.
• The invalidity of one or more of the above provisions does not affect the validity of the remaining provisions. The invalid provision will be replaced by a valid provision that closely matches the commercial and legal intentions of the parties, or, if not possible, by the current Portuguese legislation.
Unless otherwise stated, the software necessary for our services, available or used on our website, and the intellectual property rights (including copyright) for the content, information, and material on our website are owned by Maria da Luz Vieira Cabral de Melo Amaral, its suppliers, or providers. To the extent permitted by law, these terms and conditions and the provision of our services will be governed and construed in accordance with Portuguese law, and any dispute arising from these general terms and conditions and our services will be submitted to the competent courts of Ponta Delgada, Portugal.
